Satyameva jayate or Modimeva Jayate? Gujarat riots victims cry

It is almost all over for Gujarat 2002 riots victims as Retired Justice GT Nanavati handed over its report to Gujarat CM Anandiben Patel. Though there is no official word about then CM Narendra Modi during this infamous riots in that fateful year. But it is widely expected that Modi is spared from law of land. According to various reports, the Nanavati Commission that submitted its final report to the Gujarat government has found ‘no evidence’ to prove allegations of the erstwhile Modi government’s complicity in the post-Godhra carnage. The report submitted by the two-member commission, headed by Justice (retd) Nanavati, categorically says the Modi government was not involved in the riots in any way.

It seems that Nanavati Commission has ignored the clinching evidence against chief minister Narendra Modi for his alleged role in orchestrating the 2002 riots. All investigating agencies were only involved in naming accused only those persons present on the spot and committed the crime and not those who aided and abetted the communal riots. This case is not only limited to those found from the place of offence and who executed the offence. But our case is also against those who provoke, abiet, aid and planned. The commission is suffering from a delusion that those who were not present were not the culprits. It goes without saying that in past even the SIT had changed its view about the infamous speech of Modi at Becharaji in Mehsana district in 2002. First, they found it communal, but later changed its stand. It also did not entertain evidence sent by retired state director-general of police RB Sreekumar exposing laxity on part of the state government to curtail the riots.

It doesn’t stop just at giving Modi a clean chit. It also pats his government on the back for taking prompt action against some VHP and Bajrang Dal workers who were present at some venues where riots took place. The commission, according to some reports, says the Modi government took prompt action and summoned the army to control rioters. The Commission has also justified its decision of not summoning Modi for a cross-examination, saying there was no credible evidence to support the charges.

The Commission took 12 years to submit its report. During this period it got 24 extensions. But the report, ultimately, concludes what most enquiries into such riots do: the government did its best but the administration failed to act quickly because of lack of resources and staff. The only additional finding, according to reports, is that the situation became worse because of media coverage of the riots and the Godhra carnage. But then shooting the messenger has become a standard practice these days.

Fr. Cedric Prakash sj , the Director of Prashant, the Ahmedabad-based Jesuit Centre for Human Rights, Justice and Peace issued a statement that Several concerned citizens like the late Mukul Sinha of Jan Sangharsh Manch, Sanjiv Bhatt and others have tried their level best to bring the Commission – any thinking citizen will know - on track and ensure that truth prevails and that the victim-survivors are given justice. The Commission, has been full of inconsistencies, lapses and loopholes. Sinha who cross-examined several witnesses, has consistently demanded that Modi who was the Chief Minister of Gujarat at that time, had to be interrogated too. Why the Commission took the pains to deny this request from Sinha and several others does not leave much room for doubt!

Even though the Commission has submitted its report, many for the victim-survivors (and several others who have accompanied them) are the Gujarat Carnage of 2002 is not a closed chapter. The relentless pursuit for truth and justice will continue until those who presided over this carnage are brought to book. Only then, will they truly be able to sing our motto emblazoned on our national emblem “satyameva jayate” (truth alone triumphs!), he further said.

Vadodara based social activist and former retired professor of M.S. university .J.S.Bandukwala told that the Nanavati Commission is a dark chapter in the judicial history of India. A retired Supreme Court Justice Nanavati did everything possible to see that the taint of 2002 Gujarat riots does not touch Modi. In return his two sons benefited hugely through the Gujarat Government. The other Justice Mehta, was appointed to this Commission after he granted bail to the notorious Babu Bajrangi in the Naroda Patia case where over 100 people were killed. These details come from the Teheka expose of Ashish Khaitan. It just shows the rot in the highest levels of our judiciary. This Commission got 34 extensions, yet it never once summoned Modi who was the principal architect of the Gujarat genocide. Yet it could confidently pronounce that Modi is clean. Hundreds of crores of public finance was spent on this Commission , for what purpose ? I hope no judicial Commissions are ever appointed in India. The Nanavati Commission was a slap on the memory of Ahsan Jafari and the about 2000 who died, and the hundreds of thousands who suffered at that time.

All India Milli council, Gujarat chapter's general secretary and senior journalist Abdul hafiz lakhani said that though one cannot comment without reading the report but it seems that miscarriage of law was done. It has no relevance as in the interim report it gave clean chit to conspirators.

HOW BOHRAS SUFFERED DURING GUJARAT MASS GENOCIDE-2002

Herein below is a post which appeared on this forum stating the report as prepared by the weekly 'Nasime Sahar' which is run by the Raza of Kothar :-

LARGE SCALE VIOLENCE IN GUJARAT.THOUSANDS OF MUMINEEN AFFECTED

In the aftermath of Godhra incidence, large scale violence has been reported from mostly all cities, towns and villages of Gujarat during past 24 hours. Ahmedabad the main city of Gujarat is the most heavily affected with wide scale arson, looting and stabbing. It has been learnt from reliable sources that many mumineen families have suffered in yesterday's violence. Atleast six mumineen deaths has been reported so far from Ahmedabad. One mumineen family of of four was burnt alive in their house. Mr. Ehsan Jafferi, ex - M.P. and a leading congress worker's residence was attacked by a mob and was set on fire. Himself and three other family members were burnt alive in this incidence. One muminbhai - Esmailbhai Bedawala of Kutbi Mohalla died in firing incidence, while one more Jafferbhai, a rickshaw driver by profession was stabbed to death.

Many of mumineen shops have been first looted and then gutted in fire in most parts of the city. Though the main Bazar inside the famous Three Gates have remained relatively safe till now. Many families staying in cosmopolitan areas have abandoned their houses and have taken shelter in safe areas. Saifee Society near Roza Mubaraka has also reported sporadic violence. Sources from Rajkot says that, large number of mumieen shops in Rajkot has been looted yesterday. Shops on Gondal Road, Lati Plot are the worst affected. Though no new incidence has been reported since last night due to heavy police patrolling. Mumineen lives are safe. Rajkot is the home town of the new Chief Minister of Gujarat Mr. Narendra Modi.

It is further reported that at least 200 mumineen shops in Viramgam have been badly affected. Reports from Dahod say that though mumineen properties in Dohad are safe, there has been large scale violence and looting in surrounding villages which has sizeable mumineen population. Villages like, Dudhia, Limkheda, Bandiba, Limdi, Randhikpur, Pithapur have reported violence and looting of mumineen shops. Mumineen lives are safe. Reports coming in from Godhra says that, though mumineen Mohalla, Masjid and Mazar are safe in Godhra, at least five shops in other areas have suffered major damages.

All Amil Sahebs and Khidmatguzars whom we have contacted has said that, Huzurala TUS's Doa Mubarak message has reached them again and again and those kalemaat has given them consolation and saved their lives. We also pray that, May Allah Ta'la, by the Doa Mubarak of Aqa Maula Syedna Mohammed Burhanuddin Saheb TUS keep mumineen lives and properties safe. May Allah grant Long Life to our beloved Aqa Maula TUS.

10 ways the judiciary slipped up

1 THE SC should have issued suo moto notice to the government after the NHRC’s 2002 report, which had observed that “a serious failure of intelligence and action marked the events leading to the Godhra tragedy and the subsequent deaths and destruction”.

2 IN 2002, the SC should have transferred 10 major cases to the CBI or to some other independent agency. Even though the apex court ordered these cases to be fast-tracked, it ruled out the transfer of cases.

3 THE SC ordered the reopening of 2,000-odd cases, which were closed by the police without proper probes. But the apex court didn’t closely follow up on the reopened cases as a result of which most of them were again closed without meeting the ends of justice.

4 EITHER THE Gujarat HC or the SC should have taken cognizance of call records submitted by police officer Rahul Sharma in 2004. These exposed the administration’s dereliction of duty and subversion of the Gulberg Society and Naroda Patiya massacre cases.

5 IN THE wake of the TEHELKA exposé of state complicity in the riots, Zakia Jafri and the CJP filed an application before the HC asking for verification of the authenticity of the tapes. The court dismissed the application. The SC too failed to take a firm stand and didn’t pass any order. It was finally left to the NHRC to order a CBI inquiry.

6 AFTER STAYING the trials in nine cases in November 2003, the SC allowed the petitions to drag on for the next five years. It was only in March 2008 that it constituted an SIT and ordered reinvestigation.

7 THE APEX COURT enlisted Gujarat cadre cops into the SIT and in a way re-entrusted the probe into the hands of the state police, which was reporting directly to the Modi government and was accused of subverting of justice.

8 THE SC chose a retired CBI director as the head of the SIT, who visited Gujarat not more than once or twice a month and kept himself at an arm’s length from the field investigations. The SC could have instead chosen retired judges to monitor the probe.

9 THE SC first expressed displeasure with the SIT’s report on Modi and made Amicus Curiae Raju Ramachandran carry out an independent exercise of assessing the material collected by the SIT and submit a report. But in a wishy-washy order passed last September, the SC left it to the discretion of the SIT whether it would like to produce the amicus report before the magistrate.

10 THERE WERE several petitions filed before the Gujarat HC and the SC praying for an investigation into the mass graves discovered in more than a dozen places across Gujarat. Both the courts turned down the prayer.

BJP Chief Amit Shah Won't be Tried for Murder; Vindicated, Says BJP: 10 Developments

Amit Shah, the president of the ruling BJP, was greeted with garlands and fireworks by party men in Delhi after a court today said he will not face murder charges for the extra-judicial killings of gangster Sohrabuddin Sheikh, his wife and a witness a decade ago.

Here are 10 developments in this story:

1 A special court of the CBI or Central Bureau of Investigation in Mumbai accepted Mr Shah's argument that he was "involved in the case by the CBI for political reasons."

2 Mr Shah, 50, was accused by the CBI of ordering the killings when he was home minister of Gujarat under Narendra Modi, then chief minister.

3 "There isn't sufficient evidence against Accused no. 16 (Amit Shah) to put him to trial. The CBI's inference is not acceptable when the case is seen in totality," a judge said, finding most of the evidence against the BJP chief "hearsay."

4 The family of Sohrabuddin Sheikh will move the Bombay High Court against the order. "The CBI has been misused to protect Amit Shah," Sohrabuddin's brother Rubabuddin alleged.

5 In a charge-sheet in 2013, the CBI had accused Mr Shah of running an extortion racket with police officers and Sohrabuddin Sheikh, a small time criminal. Mr Shah and Sohrabuddin fell out, the agency said.

6 The CBI alleges that in November 2005, Sohrabuddin Sheikh and his wife Kauser Bi were snatched from a bus in Maharashtra and killed in Gujarat. Gujarat policemen had claimed that Sohrabuddin had links with Pakistan-based terror outfit Lashkar-e-Taiba and planned to assassinate Mr Modi.

7 A year later, a witness to those killings, Tulsiram Prajapati, was also shot dead; the Gujarat police claimed he was trying to escape from custody.

8 Mr Shah quit as Gujarat's home minister in 2010 after he was arrested in the case. He got bail three months later. The case was transferred from Gujarat to Mumbai in 2012.

9 The CBI said phone records show Mr Shah had multiple calls with the accused officers around the time of the killings. But the judge said today it is "not unnatural" for a home minister to work closely with the police as "terrorist activities have increased and are rampant all over the world."

10 "The court's verdict vindicates our stand," said Union Home Minister Rajnath Singh. Mr Shah became president of the BJP in July, two months after he helped the party deliver India's biggest election victory since 1984.

The CBI Court in Mumbai has found Amit Shah cannot be prosecuted in the Sohrabuddin case. Ever since Modi came to power, all Gujarat 2002 cases have collapsed.. Most Police Officers in jail, are getting out on bail, and have been reinstated to their old jobs in Gujarat. The CBI was described by a former Chief Justice as a parrot. It appears this is very much true. Gujarat Muslims will never get justice. It pains immensely. But what can we do, especially when so much of time, effort and money have poured in the process of securing justice in Gujarat. What worries is the message this sends to our youth , that the system is riddled with communalism, and the Courts and the police will never be just with them.

All 70 acquitted in 2002 post-Godhra riots case

A local court in Gujarat’s Banaskantha district on Friday acquitted all the 70 accused in the 2002 post-Godhra riots that took place in Seshan Nava village for lack of evidence.

A total of 14 Muslims were killed in the riots that broke out on March 2, 2002 and two persons from the Hindu community were killed in police firing.

Addition Sessions Judge V.K. Pujara acquitted the accused on the ground that the prosecution failed to present sufficient evidence on record to prove their involvement as part of the mob participating in killings.

According to prosecution’s case, an armed mob of around 5,000 people laid siege to the village on March 2 in the aftermath of the Sabarmati Express train burning. They killed 14 persons of the Baloch Muslim community, including children.

With unusual enthusiasm, Gujarat goes after activist-couple Teesta and Javed

What can explain the over-enthusiasm of the Gujarat police in investigating a case of alleged cheating involving amounts claimed to range from Rs 4 lakh to Rs 3 crore? Or the insistence, for that matter, of the Gujarat High Court that Teesta Setalvad and Javed Anand, perhaps India’s best-known activist couple, who run Citizens for Justice and Peace (CJP), be arrested and subjected to “custodial interrogation” to probe the charges? This clumsy arm­-twisting seems desig­ned to pressure them into giving up the pursuit of charges of inaction and complicity against Narendra Modi, then chief minister of Gujarat, in the post-Godhra riots of 2002.

Gulberg Society was where 69 people were killed, including former Congress MP Ehsan Jafri. Jafri’s widow Zakia had named then chief minister Narendra Modi in her letter of complaint, and though the SIT did not find enough evidence to prosecute him, the Supreme Court’s amicus curiae Raju Ramachandran felt the evidence was substantial. Setalvad’s appeal against the SIT’s finding is also pending.

CJP has fought or continues to fight eight cases of the post-Godhra riots. These cases involved some 267 people killed in rioting. In six of the eight cases, 126 have been convicted so far and 196 acquitted. Of the two pending cases, one is that of the Gulberg society.

What concerns me is that if Gujarat police arrest Teesta and Javed, how will you ensure that they will not be threatened by those who got arrested only because of their efforts? Will they be protected from these people? asks Tushar Gandhi, activist and great-grandson of Mahatma Gandhi. One fine day there will be no one left to raise voices.”

It is not going unnoticed that officials—ministers and police officers—accused in different cases, such as the Naroda Patia massacre, the Ishrat Jehan fake encounter case and the Sohrabuddin fake encounter case, have not only been getting bail, they are being reinstated in their original or even better ranks. “After Narendra Modi became prime minister, one by one, they are coming out,” says filmmaker and activist Anand Pat­wardhan. He says CJP has been a thorn in the flesh of perpetrators, referring to Teesta and Javed’s persistence in fighting the post-Godhra riot cases.

Supporters of the couple who demonstrated in Mumbai and stood in solidarity for them have been saying that they still have faith in the judiciary and are hopeful that justice will be done. The Supreme Court has not disappointed them.

Exactly thirteen years ago, on *February 28th 2002*, India witnessed one of the bloodiest chapters of history when hundreds of Muslims: men, women and children were brutally massacred, raped, looted, dispossessed in towns and villages in various parts of Gujarat; all this was in the wake of the burning of the S-6 bogey of the Sabarmati Express near Godhra the previous day February 27th 2002.

Since then, several victim-survivors with support from others, have relentlessly fought for justice and with a hope that one day they will be given their rightful place in society. Some measure of justice has definitely been delivered; however, all are aware that the main culprits particularly those who orchestrated these dastardly acts have not yet been convicted or even if they have been, they are now out on bail and move around with immunity and with tremendous impunity.

On the other hand, those who have been siding with the victim-survivors in this quest for justice have been hounded and harassed to no end. A classic case is that of Citizens for Justice and Peace (CJP), represented by Teesta Setalvad and Javed Anand who have stood resolutely with the victims in the struggle for justice and ensured 126 convictions.

Given the significance of the day and the struggle of many, some victim-survivors (from Naroda Patiya, Citizen Nagar, Ekta Nagar, Faizal Park, Visnagar and Gulberg Society) and other concerned citizens will address the media in order to highlight their concerns and demands. Indian court acquits 6 in riot deaths of British men in 2002

AHMADABAD, India (AP) — A court in western India on Friday acquitted six men accused of killing three British tourists during religious riots in 2002.

The court in Gujarat state said that it found no evidence against the accused
.

The three British Muslims were killed in the riots that erupted in Gujarat state after a train filled with Hindu pilgrims was attacked by a Muslim mob in a small town. A fire broke out — it remains unclear whether it was arson — and 60 Hindus burned to death.

The three British men and their driver were pulled from their car and set on fire by rioters.

Indian Prime Minister Narendra Modi was the state's chief minister at that time and Muslim leaders and human rights groups said Modi and his Hindu nationalist government did little to stop the violence, which he has denied. India's Supreme Court has said it found no evidence to prosecute him for the violence.

Riot-related cases have moved slowly through India's creaky legal system.

The most high profile convictions came in 2012 when Maya Kodnani, a former government minister and 31 others were convicted on charges ranging from rioting to murder, stemming from an attack in Naroda Patiya, a small industrial town on the outskirts of Ahmadabad, Gujarat's capital, that killed 95 people.

Kodnani, who was sentenced to 28 years in prison, was freed on bail in July while her appeal is waiting to be heard.

In the past few weeks, the main accused in the riots of 2002 were being released. One is an associate of the killer Kodnani, who got out earlier. This man was sentenced to 25 years in jail. But today he is out .

But the tragedy is compounded by the hounding cum torture of good Police officers who did their duty during the genocide. The most tragic case is of the IPS officer Rahul Sharma, an IIT graduate . Modi went after him when he used his technological skills, to pin point the locations of RSS / BJP leaders at the site of the 2002 killings. Modi went after him with a vengeance. He is the only officer of his batch who did not get promoted to IG rank. He was pushed into insignificant
posts, and even there he was continuously vilified . His colleagues and subordinates had been instructed to make life hell for him. To his sorrow his wife died of dengue in 2013. He begged the Government, which is really Modi, to atleast let him stay near his son and his old mother so he could look after both. Again it was refused. Finally he asked for leave without pay. That too was refused. Today he finally gave up and resigned from the IPS.

Rahul Sharma has suffered immensely . He would be the pride of a Police force anywhere in the world. But not in Gujarat.
Modi is the high and mighty. Nothing touches him even though he was the central figure in the 2002 killings

Shocking reversals in the struggle for justice mark Gujarat pogroms anniversary

The Indian American Muslim Council (IAMC - www.iamc.com), an advocacy group dedicated to safeguarding India's pluralist and tolerant ethos has marked the 13th anniversary of the Gujarat pogroms of 2002, by pledging to continue the struggle for justice, regardless of the passage of time and the vicissitudes in the electoral fortunes of the masterminds behind the genocide. IAMC has expressed its dismay over the brazen mockery of justice in cases related to the pogroms, since the new government came to power in May 2014.

The Gujarat pogroms of 2002 represent the most horrific case of mass targeted violence against a specific religious community in independent India. In systematic and organized attacks against Muslims, over 2,000 people were massacred and over 150,000 were displaced and rendered homeless. The genocide was accompanied by brutal forms of sexual violence against hundreds of women.

In several high-profile cases, the perpetrators have either been acquitted by the infamous and compromised Special Investigations Team (SIT), or granted bail after having been convicted. In parallel, activists such as Teesta Setalvad, who demonstrated exemplary courage in pursuing justice for the victims, are being hounded by the police and subject to harassment by the state under trumped-up charges.

Last Friday, six people accused in the barbaric killing of three British citizens during the Gujarat massacres were acquitted by the court for "lack of evidence." The three Britons were Saeed and Shakil Dawood and Mohammad Aswat. They were burned alive near Prantij town of Gujarat's Sabarkantha district.

"The denial of justice for the victims of the Gujarat pogroms compounds the enormity of the crimes committed against them in 2002," stated Mr. Umar Malick, President of IAMC. "The BJP government has continued in the tradition of the Gujarat government, of shielding the guilty and harassing those that are striving to bring them to justice," added Mr. Malick.

Riot victims throw in their lot with Setalvad

Several riot victims from Naroda Patiya and Gulberg Society have pledged their full support to the Mumbai-based human rights activist and founder of Citizens for Justice and Peace (CJP) Teesta Setalvad, alleging that the Gujarat government was harassing her because she fought for justice for them.

Interacting with mediapersons at the premises of NGO Prashant (Tranquility) run by Fr Cedric Prakash, the victims said that whatever relief they had got so far was because of the support and backing of Setalvad.

Naeemuddin Ibrahim Sheikh, who lost his mother and brother-in-law during attack on Naroda Patiya that witnessed killing of a total of 109 persons, said that none of his relatives, many of them wealthy and settled in the United States (US and) Europe, came to his help.

None of them even took trouble to inquire about me and my family. It is only Teesta Setalvad who came to our help. I don’t know what would have happened to the victims had Setalvad not extended her help to us,” he stated.

Another victim, Shakilabano Ansari, who lost her mother, two brothers and their wives, said that it was surprising that the riot accused were getting released on bail and were roaming around freely. The state government was victimising Setalvad simply because she helped the Muslim riot victims.

What was our fault? Why were we attacked? Because we happened to be Muslim?, she asked.

She said she would always stand like a rock with Setalvad who helped the victims when no body was there to help them.

Instead of punishing the riot accused, the Gujarat police are raising objections on Setalvad so that no one else in future came to the defence of the victimised,” said Ansari.

Abdul Majeed Usmanbhai Sheikh, who lost eight of his family members, including three daughters, three sons, wife and mother, in Naroda Patiya riots, alleged that he as a BJP worker pleaded with former minister Dr Mayaben Kodnani to prevent rioters from attacking the mosque but she asked the people to attack Muslims and their properties.

“I provided evidence in the court against her and that resulted in his conviction,” claimed Sheikh. He appreciated Setalvad for the “heroic role” she played in assisting the victims in the legal battle.

Sairaben Sheikh, who lost four members of her family in the Gulberg Society, including her son, said that she did not know how to lodge an FIR or a court case. Nor did they have money for a legal fight in the case.

It was Setalvad who gave us moral and material support and motivated us to fight the case in the court,”, said Sairaben.
We will never abandon Teesta Setalvad,” she asserted.

A Parsi by faith, Rupa Mody, a resident of Gulberg Society, who lost her minor son Azhar during attack on the Gulberg Society in which former Congress MP Ehsan Jafri was also killed along with 62 others, said: No amount of harassment from the state government could weaken our resolve to fight for justice.”

Another cop gets bail in Sadiq Jamal fake encounter case

A Special CBI court on Tuesday granted bail to a key accused in the 2003 Sadiq Jamal Mehtar fake encounter case. The policeman, now retired, is accused of bringing the 28-year-old Bhavnagar youth to the scene of the crime moments before he was gunned down. Four other accused policemen — R L Mavani, K M Vaghela, C M Chudasama and Ajaypal Yadav — are out on bail. The CBI chargesheet claims that Gohil brought Sadiq from the office of Detection of Crime Branch (DCB), then located at Dafnala, Shahibaug, where he was kept in illegal detention.

The CBI chargesheet claims that Barot had gone to Mumbai days before the encounter and brought Sadiq to Gujarat from the illegal custody of the Mumbai police.


The CBI is yet to investigate the role of the Mumbai police and then officials of IB posted in Subsidiary Intelligence Bureau (SIB), Mumbai. Due to delay by the CBI in filing a supplementary chargesheet, Sadiq’s brother Sabbir Jamal had moved an application before the CBI court in May 2013, requesting further investigation into the case under section 173 (8) of Code of Criminal Procedure (CrPC).

Teesta Setalvad and Gujarat riots: media has to be objective

You might think that enough has been written about the Teesta Setalvad case. In fact I think the opposite is true: Not enough has been written or said. That's because this case is not about one individual but about our entire system, and how in our always raucous and generally vibrant democracy, one estate (the executive) is often able to get away with wrongdoing because the other estates (the judiciary and the media) allow it to do so.

The Gujarat Police charged activist Teesta Setalvad and her husband Javed Anand with embezzling trust funds of the NGO Citizens for Justice and Peace (CJP). I am one of the founding trustees of CJP and also its current president. Trustees have included, from time to time, people like the late Vijay Tendulkar, I M Kadri, Alyque Padamsee, Fr Cedric Prakash, Javed Akhtar, Cyrus Guzder, Rahul Bose, Nandan Maluste and others, all men of professional and personal integrity. Did we complain to the police of any financial impropriety? No. Did any of the donors who gave money complain of misappropriation? No.

This police case pertains to the Gulberg Society killings, which were part of the 2002 Gujarat carnage, in which hundreds of Muslims were murdered. In Gulberg Society itself, 69 people were killed, so it was proposed at one time that a memorial should be set up to honour them. In the event, the money collected was too little to set up a memorial, so it was decided to set it aside--with the donors' consent--for future use. So if the money hasn't been used, and the trustees and donors haven't complained, where is the problem and what is the case?

The problem and the case lie in the background. We know about the 1984 massacre of Sikhs in Delhi after Indira Gandhi's assassination and the post-Babri masjid killing of Muslims in Mumbai in 1992-93. These are huge blots on our nation; what makes them infinitely worse is that while hundreds of people were killed, no one has been held accountable, and no killers have been convicted. That's because the governments and political parties wanted it that way. As a result, the Congress workers and Shiv Sainiks responsible for cold blooded killings still roam free. There was no reason to believe that the BJP government in Gujarat in 2002 would be any different, especially because evidence pointed to the involvement of very senior politicians and ministers in the killings. That's why the CJP was formed--to see if outside intervention could nail at least a few of the killers and get some kind of redress for the many innocent lives that were lost.

The CJP launched 65 cases in various Gujarat courts. As a result, 126 people, including a Cabinet minister and senior functionaries in the party, have been jailed, some with life sentences. Some cases have collapsed, notably the Best Bakery case in Vadodara, which was an open-and-shut case till the two main witnesses turned hostile. The Special Investigation Team mandated by the Supreme Court gave a 'clean chit' to the then chief minister. Recently a special CBI court dismissed the case against Amit Shah, and the CBI did not go into appeal as it normally would be expected to. One major case brought in by Zakia Jafri (the widow of Ehsan Jafri, the former trade unionist and Congress MP who was hacked to death), drags on in court, one adjournment after adjournment ensuring that its main protagonist will finally give up out of sheer exhaustion. Or the ravages of age will finally catch up with her.

In such a scenario, the doggedness of someone like Setalvad is a massive thorn in the government's side. So the strategy is to besmirch her credibility with charges of embezzlement while delaying other cases to the point of frustration. The laws of contempt of court and their stringent application by the judiciary prevent open criticism of court proceedings. However, in the case of embezzlement, it is a Bench of the Supreme Court that questioned the judgment of the Gujarat High Court: 'If misappropriation was involved', the Bench asked, 'surely it needed a study of accounts and receipts and invoices by chartered accountants. So why was the high court adamant in refusing bail to Setalvad and Anand, and sending them to judicial custody?'

The signal failure has been on the part of the media. Here were cases where huge amounts of evidence were collected and much of it was on record. Television channels have become debating societies and have neither the inclination nor, one suspects, the resources to do investigative stories. But what about the print medium? If the police say Setalvad and Anand have misappropriated funds, the press reports it that way. Couldn't they just look at the evidence presented to the court? In the Zakia Jafri case, shouldn't some newspapers have gone beyond mere reporting of the obvious? A real investigative story needs a lot of digging up of material, but when the material is so easily available, why isn't it analysed so that the real picture emerges for all to see?

In a normal criminal investigation, it is the job of the police to find the evidence required to bring criminals to justice. In particularly serious cases, the bosses of the police (the home ministry) have the responsibility of ensuring that a thorough investigation is conducted. But what happens in cases where the police force itself is involved? Or worse, even the ministers in charge play a direct or indirect role? Are they going to start an investigation against themselves?

That's when activists and the media assume roles that are of paramount importance. They might work in tandem or separately, but their objective has to be the same: To ensure that people don't get away with it, just because they are in a position to do so. It's a tough task, but an essential one to ensure that all of us live in a just society.

Even as the Supreme Court on Thursday extended the stay on the arrest of social activist Teesta Setalvad and her husband in a Rs 15-million Ahmedabad embezzlement case and referred her anticipatory bail plea to a larger bench, the Gujarat government rewarded two lawyers who have fought cases against Setalvad.

Only on Wednesday, the Bharatiya Janata Party-controlled Gujarat government appointed advocate Manisha Shah as government pleader and advocate Mitesh Amin as public prosecutor to conduct matters in the Gujarat high court.

Legal eagles in Ahmedabad see the twin appointments as the government reward given to the two ‘faithful’ advocates.

Shah represented Rais Khan, who wanted to implicate Setalvad, his former employer, in different criminal cases. She also represented one of the accused cops in a fake encounter case. Criminal lawyer Amin has represented BJP president Amit Shah and many accused cops in fake encounter cases. He is also representing 61 accused in the Gulbarg Society massacre case.

After the unfortunate granting of bail to Maya Kodnani there was an inexplicable hurry in the manner in which the matter as listed for hearing of the appeal in the Gujarat HC. Day after tomorrow the hearing of the appeals begins. Victim Witnesses have filed Interventions and also a Recusal application.;

NARODA PATIA CASE - Riot victims seek another bench for appeals

Judge Currently Hearing Pleas Had Recused Self From The Case Earlier

The survivor-witnesses of the 2002 Naroda Patia massacre case, on Monday , objected to the Gujarat high court bench headed by Justice Ravi Tripathi hearing the appeals of the convicted accused of the case. Naroda Patia witnessed the biggest massacre during the communal riots of 2002. The survivors, who have questioned the acquittal of certain persons by the special SIT court in this case, have filed an affidavit stating that Justice Tripathi had, in the past, recused himself from hearing a case pertaining to one of the appeals following an appearance of advocate V H Patel in the matter. Now, the same case had come before the same bench as all matters pertaining to the Naroda Patia massacre are to be heard along with the appeals filed by former minister Maya Kodnani. This time, however, the advocate has changed in the case. The witnesses have argued that since the judge had said `not before me' to a case, he cannot hear the same case again. The witnesses have urged the high court that the case, which was not heard by Justice Tripathi in the past, should not be heard by his bench now, sources said. n hearing of such appeals, all related matters are usually heard together. As per the present sitting of judges in the high court, the Naroda Patia massacre appeals are being heard by Justice Tripathi's bench. When Kodnani's plea for quick hearing came up before him, he kept March 23 for final hearing and ordered that all cognate matters to be placed before him. Now the witnesses do not want the matter to be heard by this bench and this is apparent from the reservation they have expressed by pointing out a single matter.

Incidentally , Justice Ravi Tripathi is to retire in a month.


On Monday , advocate Kalpesh Shastri, who appeared for the witnesses, mentioned this issue before a bench headed by Justice MR Shah and sought time for hearing. This was because Justice Tripathi's bench was not available on Monday .Next hearing in the matter is on March 26.

Updates on two ongoing cases today.

Gulbarg Trial still at the Special Sessions Court stage (SIT delayed the trial for over two years refusing to give us (Survivors +CJP) critical documents that reveal the role of senior police officers, then Commissioner of Police, P PC Pandey, then Joint Commissioner of Police, MK Tandon then Deputy Commissioner of Police, Gondia and Chudasama.)

The trial resumed a few weeks ago in the Trial Court (the fourth Judge is now hearing the trial. Final arguments are on. Our arguments under section 319 are being led by adv SM Vohra (in January 2010, senior advocate Mihir Desai had made these very same arguments before the first judge BU Joshi that we had to seek transfer of the case away from after his behaviour towards the Survivors was very offensive--for the transfer we had to go up to the Supreme Court !!!--it took over 18 months !!!!)

Even today I received a call from Vohrasaab saying how the SIT was trying to mislead the lower Court saying that SC had agreed to a mere departmental inquiry into the role of these officers. This is simply not true. The SC has left the issue of culpability to the lower courts. So now we have to bring this to the notice of the Sessions court!!

It is a harrowing battle that requires daily monitoring and a united team. I sometimes wonder how we do it. It would not be possible without the wonderful team we have in Mumbai and Ahmedabad.

Meanwhile the man who even today appears as SIT special Public Prosecutor, RC Kodekar has been conveniently appointed a special Public Prosecutor by the state of Gujarat. The woman lawyer who appeared fist for Raees Khan Pathan in the Gujarat HC, then for the state of Gujarat opposing Javed and my ABA, Manisha Luvkumari has also today been appointed as special public prosecutor by the state of Gujarat.

`Pande, Gondia's inaction led to Gulbarg killings'

The victim-witnesses of Gulbarg Society massacre case stated before the special SIT court on Thursday that dereliction of duty on the part of then police commissioner P C Pande and then DCP P B Gondia had resulted in the murder of 69 persons at the housing society during the riots of 2002.

The witnesses have demanded that Pande, Gondia, then joint police commissioner M K Tandon, and former investigator S S Chudasama be made accused in the massacre case. They had filed a petition under section 319 of the CrPC on basis of evidence that had come on record during the trial.

The lawyer of the victims, S M Vora, submitted that Pande and three others did not take sufficient action to protect lives. He cited call details to assert that Pande had remained in his office at Shahibaug from 11 am to 6 pm while the killings had occurred between 3 and 5 pm. Pande had inputs from the Intelligence Bureau, but he did not act or send any police reinforcements to protect lives, the lawyer said.

Advocate Vora claimed that Gondia had kept sending false messages to police control room saying that they were running out of weapons and cartridges. On the contrary , evidence suggests that they had enough weapons to control the crowd, the lawyer said. Gondia had sought additional cartridges but each policeman with him had had 50 cartridges along with a .303 rifle, the lawyer submitted.

The SIT will reply to this on Friday . Sixty-nine persons were killed at Gulbarg Society on February 28, 2002.

Naroda Patiya Case: Convict Babu Bajrangi Gets Three-Months Bail

The Gujarat High Court today granted temporary bail of three months to former VHP leader Babu Bajrangi, who is convicted in the 2002 Naroda Patiya riot case, on medical grounds.

A division bench of Justices Ravi Tripathi and R D Kothari allowed the interim bail plea moved by Bajrangi's wife seeking his release for 90 days for his eye treatment.

Bajrangi had moved the plea seeking temporary bail to undergo proper eye treatment. He had stated that he is turning blind gradually and that he needs to be out on bail for its treatment at a private hospital.

He is one of the 31 convicts in Naroda Patiya riot case of 2002 where 97 people of minority community were killed. Bajrangi was awarded 'imprisonment till death' by a special trial court in August 2012.

Bajrangi had challenged his conviction before the High Court, but it had been stayed by the Supreme Court.

The former VHP leader was earlier granted temporary bail five times by the Gujarat High Court on various grounds

Earlier, Bajrangi's wife Meena Patel had written a letter to Gujarat Governor O P Kohli seeking mercy to release her husband as he was losing his vision.

Naroda Patiya is one of the nine cases probed by the Supreme Court-appointed Special Investigation Team (SIT).

A Special SIT court had in August 2012 awarded life imprisonment to then BJP MLA Maya Kodnani, Bajrang Dal leader Babu Bajrangi and 29 others for the 2002 riots at Naroda Patiya.

Officer who probed 3 Gujarat riot cases to be CBI additional director

The government on Wednesday cleared the way for the appointment of Meghalaya cadre officer YC Modi as additional director of CBI by moving out present incumbent Archana Ramasundaram.

The choice of YC Modi for the CBI job is viewed with interest, given his past stint in the Supreme Court appointed Special Investigation Team (SIT) which probed Narendra Modi in 2002 Gujarat riots cases.

The SIT eventually gave the then-chief minister a clean chit in the Gulbarg society massacre case in which a former Congress MP was among 69 people massacred by rioters

In the SIT, YC Modi had probed the three most high profile cases -- Naroda Patiya, Narodagaon and Gulbarg Society-- for which trial is underway.

Modi was inducted into the SIT by chief RK Raghavan, a former CBI director, who supervised the probe in the Gujarat riots cases.

“YC Modi was inducted into the SIT after the Supreme Court removed two IPS officers of Gujarat from the team. SIT chairman Raghavan was instrumental in bringing YC Modi into the body,” a senior official from Gujarat said.

The top cop also had an earlier stint in the CBI, during which he supervised the probe on the murder of Gujarat BJP leader Haren Pandya, once a rival of Narendra Modi.

In August 2011, the Gujarat high court acquitted 12 persons convicted in the Pandya murder case, slamming the CBI for a “botched up and blinkered investigation.”


"The investigating officers concerned ought to be held accountable for their ineptitude resulting in injustice, huge harassment of many persons concerned and enormous waste of public resources and public time of the courts," a division bench of the HC noted in the judgment.

The entire CBI team under Raghavan had only one objective, how to save Narendra Modi and those close to him. Raghavan played his part. Modi has rewarded him and his team in abundance, But justice has been lost for ever.

More important CBI has lost its halo. It is a puppy in front of Modi. Every policemen accused , even the police shooters involved in the Sadiq Jamal and Sohrabbuddin cases have been released and are up for attractive promotions.

How can we Muslims trust Modi ?

AHMEDABAD: A special SIT court in Anand acquitted on Thursday three persons accused in the 2002 Ode massacre case. The three accused — Nikul Ravji Patel, Ankur Patel and Mohan alias Sachin Patel — had earlier jumped bail and fled to England, Australia and Singapore respectively to evade trial. Two of them were extradited while the third returned to India to face trial. Special judge M S Bhatt gave the three accused the benefit of the doubt and acquitted them as the court did not find clinching evidence against them.

The three persons were put on trial for murder and rioting during the communal riots in Ode in which three persons from the minority community were killed in Malav Bhagol area of the town.

In all, 47 persons were charged for the offence. Forty-one persons were tried earlier and the court had convicted 10 persons, sentenced nine to life imprisonment and acquitted 31 accused.

Zakia Jafri and Teesta Setalvad (Co-petitioner) are fighting a case against many powerful people in Gujrat to bring the culprits to book. Zakia Jafri has also accused the present Indian Prime Minister Narendra Modi and then Chief Minister of Gujrat in this case. Teesta Setalvad has won 117 cases against the rioters in Gujrat. The state is doing its best to cripple us by freezing our accounts: Teesta Setalvad

The allegations

◾The Home Ministry has slapped notices on Gujarat riots activist Teesta Setalvad.

◾It has asked the CBI to freeze her bank accounts and probe fund transfers.

◾Govt says Teesta's company Sabrang Communications has committed Foreign Contribution Regulation Act violations.

◾A case of cheating has also been filed in connection with a memorial to the victims of Gulberg Housing Society massacre.


The defence

◾Teesta says the govt is witch-hunting her because she has helped victims of the 2002 Gujarat riots.

◾She denies all allegations, stating that her company has operated within the rules.

◾She blames the Gujarat govt for vilifying her organisations and protecting perpetrators of the riots.

Some describe Teesta Setalvad as a thorn in the BJP's flesh; some as an inconvenient pest who just will not let the 2002 Gujarat riots be forgotten.

Many others see her as a brave social activist who fights relentlessly for justice and secularism.

The fact is that, today, one cannot discuss the Gujarat riots, its victims, and the perpetrators, without a reference to Teesta.

She began her career as a journalist about 33 years ago. In 1992, following the riots in Mumbai, she started a magazine with Javed Anand devoted to discussing communalism and how to fight it and called it Communalism Combat.

She also started an Education for Plural India programme called Khoj. Since 2002, she has been involved in pursuing justice for the victims of the post-Godhra riots. This has made her a target for all those who would prefer her to keep quiet.

It's no coincidence that about 16 inquiries have been initiated against her by the state and the central governments. She has had to seek anticipatory bail four times already.

SOME EXCERPTS FROM TEESTA'S INTERVIEW :-

Ours is a typical, classic case of the State and its organs being used as an outlet for motivated vendetta of the vilest kind. Now that our bail application is due to be heard on 7 July, all sorts of diversionary tactics are being used.

All that the state of Gujarat appears to be interested in is humiliating and vilifying us in the public domain.

This is just part of a sustained campaign of false allegations to prejudice ongoing trials, in which powerful functionaries of RSS and BJP face serious charges. Why does no one ever question the state of Gujarat that has been bent on thwarting its legal obligations to prosecute those guilty for mass murder in 2002?

Why is the state of Gujarat, instead of ensuring the conviction of 120 persons who have been brought to book through witness testimonies, bent on setting them free?


Today our team is working against all odds and state vendetta, to make sure that the guilty are punished.

Only recently, in the case of Maya Kodnani's appeal (that was being hastily pushed in the Gujarat High Court), it was our intervention that ensured that due process was followed and that appeals of all accused were heard together.

It is this continued work of ensuring legal aid to the needy that is the greatest irritant for this government.

The motive is clearly to keep us embroiled in these legal tangles to paralyse our work that upholds India's Constitution and challenges the very ideological frame of this government - driven by the Rashtriya Swayamsevak Sangh's commitment to a Hindu Rashtra - and to keep the mobs that support this ideology gleefully content.

The single biggest threat to the regime in power is the Zakia Jafri case, which will be heard in Gujarat High Court on 7 July.

The widow of Ehsan Jafri, assisted by us, seeks to prosecute a number of powerful people, including Narendra Modi, for their role (criminal, administrative) in deliberately allowing loss of life and property in 2002.

Through our efforts, we have also achieved 120 convictions to life imprisonment, thanks to the monitoring by the Supreme Court of India and protection given to 570 eye-witnesses

The Naroda Patiya verdict, Odh and Sardarpura verdicts, apart from the Best Bakery case, are historic achievements that have created lasting jurisprudence.

My learning or realisation is that governments may tolerate seminars, writings and workshops against them, but when you show the grit and the determination to hold them accountable legally, when heads roll, when convictions happens, when the legality behind mass crimes is backed by path breaking rights-based jurisprudence, it is then that you become a real threat to the government and to the system.

Unfortunately, despite us bleating about the "success" of electoral democracy, how much are we concerned about the culture of impunity, the pathetic rates of convictions in mass communal crimes, and the poor quality of investigations and the supine behaviour of state prosecutorial agencies?

Do we have 'national debates' on these issues, especially the 'culture of impunity' which prevails?

Speaking of the immediate past, to achieve 120 convictions to life imprisonment of powerful perpetrators is no mean deal.

Apart from the Kodnanis and Bajrangis, those convicted are from powerful communities from within Gujarat's rural caste structure, whose conviction was possible because of the integrity of witness testimonies alone.

Imagine a farm labourer, whose family of 33 was burnt alive, testifying openly against the murderers, empowered by the protection granted by the Supreme Court of India.

This has simply never happened before.

To give voice and face to the survivors of mass crimes has been our aim and policy, whether it is Bombay 1992-1993 and or Gujarat 2002.

Substantive justice may have eluded us as yet, but the level of broad-based understanding and appreciation of the events of 2002, the evidence related to state complicity and the heaps of documentary material that our efforts have put into the public domain have been historically unprecedented.

The investigation documents, now in the public domain, that we extracted while preparing Mrs Jafri's Protest Petition, are not just revelations about the pre-meditated nature of the crimes of 2002. They are a valuable study for students of crimimology and law, on where and how evidence can be collected for prosecutions, in future.

The costs of these efforts, human and material are, however, very high, largely because people expect you to get tired, to give up, to flit to another issue. To persist with a cause, and through this persistence, achieve some substantive results, is seen as abnormal, since our accepted norm is a culture of impunity.

When the Prime Minister of a secular nation not only visits the Pashupatinath Temple (Nepal, 2014) but also makes offerings worth Rs 4.96crore, what are we to make of this?

Look at the symbolism, the history and culture that is being pushed through the Ministry of Human Resource Development and the appointments being made to the Indian Council of Historical Research, the National Council of Educational Research and Training, the Bombay University Vice-Chancellorship etc.

Today we have governors of states who owe allegiance not to the Indian Constitution and the tricolour but to the idea of a Hindu Rashtra. The signs are there for all to see. They are ominous. All our institutions will have to resist this assault.

Travel ban imposed on human rights defender Teesta Setalvad

On 29 June 2015, a travel ban was imposed on human rights defender Ms Teesta Setalvad one week before the Supreme Court proceedings on granting her bail.

Teesta Setalvad is a journalist and founder of Sabrang Trust and Citizens for Justice and Peace (CJP). Sabrang Trust was established after the 1992-1993 communal violence in Mumbai, and works to promote conflict resolution and support peace building. CJP was established in April 2002, in the immediate aftermath of the communal violence during the Gujarat riots, to provide legal aid to the survivors of the riots, and has been instrumental in obtaining the 117 convictions against perpetrators of the violence, among which are politicians and government officials. Narendra Modi, who has been Prime Minister since 2014, was Chief Minister of Gujarat at the time of the riots and was criticised for his conduct at that time.

Front Line Defenders expresses its concern at the travel ban imposed on Teesta Setalvad and continuous harassment against her, as it believes the travel ban to be an attempt to intensify the harassment of the human rights defender, and to repress her legitimate work in the defence of human rights.

2002 riots: Gujarat HC to hear Zakia Jafri's plea on July 27

AHMEDABAD: Gujarat high court has kept July 27 to start final hearing on the revision application filed by Zakia Jafri against lower court's clean chit to Prime Minister Narendra Modi and 58 others in connection with the 2002 riots.

The apex court asked the SIT to probe the conspiracy aspect behind the 2002 riots on complaint filed by Zakia Jafri, widow of former Congress MP Ehsan Jafri. After cops did not register her complaint in 2006, she moved courts demanding investigation against Modi and others

Hearing in Naroda Patiya Appeals Begins (July 28, 2015)

After repeated attempts to rush through Maya Kodnani's appeal (April 2015), finally the hearing of the Naroda Patiya Appeals of 32 Convicts Began before the regular bench hearing the appeals. Advocates Yusuf Shaikh, Advocate Altaf Jidran and Adv Kalpesh Shastri (CJP Legal Team) are there on behalf of all the Survivors who have independently
a) opposed these appeals;
b) appealed against acquittals of other accused against whom there is evidence
c) Pleaded for Further Investigation into the Roles of PI KK Mysorewala and SRP Personnel against whom the SIT probe was shoddy.

To further our arguments, our team will argue consisting of Adv Mihir Desai and others. Teesta Setalvad Secretary Citizens for Justice and Peace will assist.

July 2015 saw drama upon drama unfold in the Gujarat High Court when first Justice GB Shah said 'not before me.' Then the new bench constituted, Justices MR Shah and Kalpesh Jhavery both said 'not before me'. They also said that they were constrained to add that one of the accused had approached them! The electronic media ignored this sensational story (predictable??) as also the story that Judge Jytosna Yagnik's security was withdrawn by the Gujarat government. She is the Special Judge who had convicted 32 persons to life imprisonment on 29.08.2012. Since then there are reports that security has been restored.

Accused have submitted some documents and translations.. When we requested a copy, the Judges stated that we would have to pay a stupendous sum of over Rs 1 lakh (ridiculous rules!!) We are filing an application to the Registry for exemption of costs! If not we will have to challenge this in the Supreme Court.!!!!!

We shall --as soon as time permits -- make available a detailed Chronology of the Case. As also make available all copies of the Applications Opposing Appeals etc filed on behalf of Survivors. We shall also put in the public domain the Written Arguments prepared by our team.

Until then please keep a watchful eye on these critical appeals and disseminate the information as widely as possible.

Muslims will never get closure on the Gujarat 2002 killings. The principal figure connected to that massacre is Narendra Modi.....Maya Kodnani and Yakub were convicted by lower courts, in the killings of hundreds. In Maya Kodnani's case it was the butchery of women and children. Yet today she is out on bail, and most likely will be acquitted by the High Court. But Yakub has been hanged. Justice has to be blind .

In Gujarat justice depends on your religion. Police officers and BJP leaders charged with the killings in Gujarat have been released after Modi became PM. They were rewarded with high posts. Modi's right hand man Amit Shah spent months in jail, until set free by a highly ambitious Chief Justice of India. Modi got a clean chit through retired Justice Nanavati and today his sons carry much weight in the Gujarat judiciary. The one exception is Judge Yagnik who convicted Kodnani. She lives under high security.
