Statement of concern regarding PM’s takeover of the Teacher’s Day

We are disturbed by the circulars issued by the CBSE and other authorities dealing with different systems like the Central Board of Secondary Education (CBSE), Directorate of Education, Delhi, Kendriya Vidyalaya Sangathan, etc. asking schools to make arrangements to ensure that all the school children across the country listen to the Prime Minister’s address to the children in their school premises on the occasion of Teacher’s Day on September 5.

It is an extraordinary and unprecedented step in the history of school education in independent India. Not only does this order treat children as passive and captive elements who do not have a view of their own, it also violates the international convention of Child Rights which says that children have a right to form opinion and therefore they need to be asked whether they would like to be part of such an extra-school activity beyond their usual school hours.

Although the MHRD has clarified verbally that this is a voluntary activity and not binding on the schools and children, yet the written orders by the authorities are still in effect asking the schools to furnish the status report by 2nd September and remain prepared for surprise inspections in this regard.

Moreover, schools are being asked to spend from their own resource pool which in itself is very poor and inadequate. The resources identified for school related activities are sought to be diverted for an extraneous activity, not intrinsic to the curriculum.

The Prime Minister is taking over the day, which belongs to the teaching community and pushing them off stage. This attempt to hegemonize social spaces needs to be condemned and resisted. The Prime Minister is not the Teacher-in-Chief of the country and he should leave the children alone.

We demand that the orders issued in this regard be withdrawn immediately and the solemnity and gaiety of the day be left untouched.

In The Virile God’s Graveyard

( I had spent a week in Gujarat in February-March,2007 and published two reports in TEHELKA. Reproducing the first part to remind myself that it was again in Gujarat where the fear of ‘Love Jihad’ was invented in its present incarnation.)

Gujaratis, especially the Hindus, are in awe of Modi. They seem to have found their long lost “man” in him. Manliness is what Gujarati Hindus seem to be craving for. I am told by a group of students that Muslims eat non-vegetarian stuff, have muscular bodies and are cruel by nature. Hindus, on the other hand, are vegetarians which makes them soft in body and nature. That is why we are always at the receiving end. Narendra Modi is the man who showed how it can be reversed.

An activist friend tells me that there was a campaign lamenting the loss of mardangi (masculinity) among Hindus resulting in a situation in which actors could flaunt their Muslim identities now.

In Vadodara, an attempt was on to open an exclusive gymnasium for Hindu men to improve their masculinity.
This was a loss of ground as there was a time when they had to change their names to sound Hindu. Could Dilip Kumar dare act as Yusuf Khan? Hindus have become cowards and are looking passively at their sad decline, say the pamphlets.

The guilt Hindu males seem to suffer from emanates from this imagined loss of masculinity. Hindu males here have been exhorted to build their bodies to be able to match the muscular Muslim male.

I am told that there was an attempt to open a gymnasium in Vadodara exclusively for Hindu men following the realisation that Hindu girls were being lured by Muslim men. Pamphlets with pictures of motorcycle-borne young Muslim men looking at Hindu girls are in circulation for the last 10 years. It has had the desired impact.

Many, from cosmopolitan students to writers of repute,believe that “bad” Muslim boys stand outside colleges to lure innocent Hindu girls. They fall prey to their cunning ways, convert to Islam and end up as wives of Muslim men. What is even worse is that after ruining them, these lumpen leave them in the lurch. Poor Hindu parents cannot even take them back as they have been converted and ruined! When asked about proof, the students tell us that one can find Gujarati dailies reporting such marriages.

My friends in Vadodara tell me that in the last decade all the akharas have been purged of non-Hindu elements. It would not be an exaggeration to say that they have been overtaken by elements belonging to the Vishwa Hindu Parishad or the Bajrang Dal. They are now the new spaces where a new Hindu male sociology is emerging.

We are in possession of a leaflet issued in the name of Babu Bajrangi which says: “In every home there is a live bomb. It can explode any moment. Who is this live bomb? Our daughters!” It goes on to ask parents to keep an eye on their daughters. If your daughter is missing, you can depend on the services of Babu Bajrangi which are absolutely free. “If you save one girl, you save a hundred cows,” the leaflet concludes calling upon everybody to start saving the bombs (our daughters)!

Babu Bajrangi has made it his job to “rescue” the misguided and fallen Hindu girls from the clutches of badmash and lafange (the lumpen). You’ll find large posters in the colleges of Ahmedabad bearing the Bajrangi’s warning. The stories of very rare cases of Hindu–Muslim marriages have been woven into a pattern. The thought that their own girls are being used to increase the tribe of the badmash , i.e. Muslims, makes the Hindu blood boil.

I am reminded of a report circulating on the Internet that Hindus in England have complained that paid Muslim “goons” are forcibly converting their girls to Islam. The fact that it is happening abroad, as well, proves beyond doubt that there is, in fact, an international conspiracy to increase the population of Muslims, that too at the cost of Hindus and their honour.

Combine it with the widely-held belief that Muslims across Gujarat are busy slaughtering cows. What business do they have to smuggle cows out of the state, a young boy asks us angrily. Activists tell us that lorries carrying cattle are stopped by Bajrang Dal gangs and they forcibly load one or two cows on the truck to implicate the trader in cow slaughter cases. Gujarati dailies flash such “factual reports” at regular intervals, never to be verified by any agency and, therefore, adding to “truth” about Muslims, or their “true reality”, quoting a student we talked to. This account of truth about Muslims is similar to the truth being taught to the Class x students of Rajasthan by their new Social Science textbooks that on the state’s western borders resides a particular community that has been found to indulge in the trafficking of minor girls and cows.

Middle class Hindus seem to suffer from a guilt complex that they have not done enough to retrieve their honour. Their vegetarianism would never allow them to be as “powerful” as Muslims. Most of them cannot forsake their families. Narendra Modi doesn’t have a family and can’t be corrupted as he has conserved his virility. He could take on the world railing against him after March 2002 and remained firm. The cunning that helps him outwit opponents in his party and elsewhere makes him a modern day Krishna. These are the ‘praiseworthy qualities’ of Narendra Modi which endear him to the masses, says a writer, who is otherwise critical of his role in 2002.

Swami Vivekananda aspired for a man who would have the mind of a Hindu and the body of a Muslim.

Narendra Modi showed that the Muslim body could be annihilated, made irrelevant.

A journalist friend tells me that after the success of Hrithik Roshan’s first film, Kaho Na Pyar Hai, RSS mouthpiece Panchajanya commented that in Hrithik Roshan we could see the entry of a new, real Hindu Putra. That he went on to marry a Muslim girl could also be treated as a revenge on behalf of those Hindus who have lost their daughters and sisters to Muslim men.

Narendra Modi vanquished the Muslim body, Hrithik Roshan made it evaporate by integrating it with himself. Roshan has scored another hit at the box office, Modi would continue his run at the political box office.

Gujarati Hindus seem to be all too eager to pay for it with their souls.

Muslims and the Modi government: Disturbing trends from the first 100 days

The trends emerging from the first 100 days of the Prime Minister Narendra Modi-led Government do not appear positive for the Muslim community on any of the essential parameters of security, inclusion or prospects for development.

Fringe on Centre Stage: Portent for Violence and Polarisation

The first major concern of Muslims since the swearing in of the BJP government is the possibility of increased violence against the community. Though the BJP Election Manifesto for 2014 mentions ensuring a peaceful and secure environment, it is clear that a wide range of fringe groups espousing violence and professing allegiance to the Hindutva ideology seem to be striving towards occupation of the centre stage.

Incidences of violence started right from the day of counting of votes on 16th May 2014 when two mosques were attacked near Mangalore in Karnataka and continue through attacks on Muslims in Pune, conflicts in Hyderabad, riots in Saharanpur and other incidences of tensions and conflicts in different parts of the country. More than overt violence, it is the series of virulent statements being issued by leaders of different Hindutva groups, including some BJP leaders, and the launch of a systematic campaign around “Love Jihad” and statements like those of BJP MP Yogi Adityanath “If they take one Hindu girl, we will take 100 Muslims girls,” are all vitiating the atmosphere like never before to instigate polarisation and could result in outbreak of violence at a large scale.

However, the first 100 days have shown that the government has not taken any strong action or sent a clear message to rein in the fringe Hindutva groups who are consistently vitiating the communal atmosphere in the country. This indicates that preparations for putting in motion Plan B- of coming back to power in 2019 through communal polarisation – seem to have started with all earnestness and may continue to be operative on the fringes and acquire centre stage if and when Plan A appears to be failing. Whether Plan A or Plan B would be a dominant strategy for elections 2019 could become clear by mid 2018.

In so far as Muslims are concerned, the issue of security has already come under a cloud during the very first 100 days and the community could face constant threats in the coming years.

The previous UPA government, with an eye on Muslim votes, had started some initiatives for policy transformations in the field of reservations and Sub Plan but could not operationalise them. BJP, with a traditional antagonism for the Muslim community and no dependence on the Muslim vote to come to power (as shown in the 2014 General Elections), will not be interested in any such transformational policy initiatives for the Muslim community and it has amply demonstrated this in the Union Budget for 2014 even though the repeated slogan both before and after elections by none less than the Prime Minister is Sab Ka Saath- Sab Ka Vikaas (Every one included- Everyone developed).

Another problematic to positive policy formulations for the Muslim community by the BJP led government would be very low participation of Muslims in the ruling BJP at all levels. During 2014 Lok Sabha elections, the party gave tickets to only 7 Muslims out of the 482 candidates it fielded (just 1.45 per cent) and none of its Muslim candidates could win- making it the first time that the ruling party has no Muslim member in the Lok Sabha and only one Muslim as a Minister in the entire Union Government taken from the Rajya Sabha. The fact that BJP did not induct any more Muslims in the government despite having one more senior Muslim member in the Rajya Sabha, even when it gave place to defeated candidates or to those who were not members of either house of Parliament shows that there can be very little representation for Muslims in the present government and in the echelons of policy making.

The approach of the government to the policy requirements of the Muslim community can be further gauged from the very first statement of the lone Muslim minister in the Union Cabinet (charged with the Ministry of Minority Affairs) who declared that Muslims are not a minority!

Unpromising Budget

The BJP manifesto for 2014 General Elections had promised to give adequate focus on the development of minorities, particularly Muslims but only 0.7 percent of Total Plan Fund of Union Budget 2014-15 has been earmarked for minorities who constitute 19.5% of the population.

Muslims who are over 13.4 % of the population of the country and constitute 73 percent of the minority population (as per 2001 census) are recognized as the most backward among all minorities requiring special attention for their development. The other issues that plague the Muslim community are communal violence coupled with social and systemic exclusion. Hence any holistic approach for a meaningful advancement of Muslims must necessarily include provisions for development; mechanisms to ensure security; and appropriate policy formulations to secure genuine inclusion. In fact in the Indian context, the issues of security and inclusion of Muslims are critical and determine the development trajectory for the community.

Muslim traders being forced to close down their business in ‘VIBARANT GUJARAT’

10 Gujarati Muslim traders have alleged having been forced to close down businesses over past one month. The latest complaint was been filed on Thursday by hotelier Mustafa Patel, who claims to have shut down his Jyoti Hotel on Viramgam highway, 90 minute drive from Ahmedabad, after receiving threats. His petition says that despite court orders Police has refused to provide him protection.

Earlier the Commission had received complaints from nine traders of Chhota Udepur, alleging their businesses have been ruined. The complaint says, that sarpanch of village Baroj, Jayanti Rathwa engineered a riot in the area to take away the luxury Transport business from his competitor Irfan Abdul Ghani. The region witnessed communal clashes following a minor altercation between adivasis and muslims.

Many Minority industries were attacked, set to fire. SP, DIG went there, FIRs were lodged but till today no one has been arrested,” adds the complaint.

Muslims and Advisasi have lived together in the area for centuries and smell a conspiracy to create bad blood by forcing minority community out of business in the region.

Those who have been forced to close down their business are Kasim Ahmed (scrap dealer), Ahmed Airf (minerals), Farooq Bhai (power production unit), Yakub Mohammad (mineral production), Saifudin Ali (power production), Ahmed Khoka (power), Shabir Bhai (mineral production), Majid Khan (power) and Harun Abdul Malajher (mines).

Let us come back to Palitana,– a sacred place for Jain community. There is a very famous temple, jains come from all over the country and even from aboard. In Temple vicinity, meat and eggs are not allowed but in rest of town why Muslims are not allowed to do the business of meat? Recently in Ahmedabad city, all slaughter houses and meat shops were forced to close on account of Jain festival for about a week.

Two powerful features of 2014 are the sudden rise of Islamic State in Iraq and Syia. Originally a branch of Al Qaida, it has successfully moved out of the shadow of Osama Bin Laden and established a fearsome image in the region, due to its ruthlessness in killing its prisoners. Al Qaida has been eclipsed due to ISIS. Equally important is the rise of Hindutva in India, due to Narendra Modi, This has generated much unease among Muslims throughout India. In particular the sudden rise in communal riots all over India, but particularly in those areas where elections are due, has caused panic among Muslims. There is a suspicion that the BJP leaders are deliberately sowing hatred against Muslims with an eye to winning elections.

The combination of these factors must cause worry to our Intelligence networks and to our armed forces. Al Qaida may consider this as an ideal opportunity to get a foothold among Indian Muslims. So too would the Islamic State. If they succeed, it would be a most serious security threat to the country.

The ideal would be for Muslims to say no to both the Islamic State and to Al Qaida. I am sure most Indian Muslims will stay away from them. But you need just a few to create a security nightmare.

The best is for the RSS / BJP to tone their subtle communal drive against Muslims. At this stage the wise approach is Narendra Modi to make Indian Muslims feel that they are a part of this country. Unfortunately his actions since becoming PM prove otherwise. The release of Kodnani and Bajrangi has been resented by Muslims. Similarly the appointment of Sathasivam as Governor of Kerala is being viewed as a payment for the favorable ruling given by the then Chief Justice, on the bail by Amit Shah. More important the role of Western UP BJP leaders in creating an anti Muslim hysteria is most sickening. Narendra Modi must reverse this slide, where most Indian Muslims feel unwanted in the country. That is the best way to stop al Qaida or the ISIS from entering into the country.

Politics without the minorities

The penchant and proclivity for making India Hindu is not a new phenomenon in Indian political life; but until the 2014 election, it did not have the power or the heft to pose a serious challenge to the idea of India

Mr. Modi has not distanced himself from any of the outlandish statements of his supporters from Hindu hard-core organisations; there are no rumours that he even mildly upbraided them. Till now as “the Prime Minister of the entire nation, not just the 31 per cent who voted for him,” he has allowed space to those who speak of and act in the name of a “Hindu nation.” This has given the Sangh Parivar a free hand to polarise the public sphere. There is an interesting pattern to these controversies. Whenever a storm breaks out in the context of rising communal tensions, senior BJP leaders evade the issue and simply state that Mr. Modi’s agenda is “sabka saath, sabka vikas,” as though repeating this generic statement would heal communal wounds. While on the evening news shows, party spokespersons make the majoritarian case plainly and blame the usual “secular suspects” for perpetrating vote bank politics as opposed to their “India first” approach. If this is a calculated strategy, which it seems to be, then why would Mr. Modi or the BJP distance itself from Mr. Adityanath’s utterances. Far from doing this, he was asked to open the Lok Sabha debate on the communal violence Bill and later appointed in charge of the by-poll campaign in Uttar Pradesh. The message is loud and clear: the so-called “fringe” elements and “loony outfits” (as the media often describes them) are free to do their work, unchecked, while Mr. Modi will get on with growth and governance. In some respects this is a continuation of the doublespeak witnessed in the election campaign, but, post-election, it assumes a new meaning because now it is party leaders and elected MPs, and not just the religious right-wingers, who are indulging in communal speak.

From Kerala to Karnataka to Maharashtra and Punjab, there have been incidents of BJP and Sangh Parivar activists disrupting cultural events that are critical of Mr. Modi and his government.

The party demonstrated that it can win a majority without minority support. One right-wing Hindu leader, who had a front-row seat at Mr. Modi’s swearing-in, said the “tables had turned.” The polls were a “setback to Muslim politics” used by “foreign and divisive forces to destroy our identity,” he said. “It was time for them to learn their lessons. Muslims will be treated as common citizens — nothing more, nothing less. And, they must learn to respect Hindu sentiments. If they keep opposing Hindus, how long can they survive?” What this suggests is that if this political climate continues, minorities will get pushed out of the system through electoral politics. Mr. Modi is creating a new model of running politics without minorities.

“Now it is reflected in the politics of the country. A large number of foot soldiers in the RSS-BJP do believe that the political Hindu has arrived,” This marks a dramatic shift — a break from the past for the Sangh Parivar. In consequence, for the first time in independent India the BJP has won an absolute majority. This time, there are no coalition impediments. Arguably, a majoritarian agenda may well prevail in the RSS-dominated government. Besides, Mr. Modi and the RSS are on the same page ideologically which was not often the case under Mr. Atal Bihari Vajpayee. In his first 100 days in power, Mr. Modi has defied those who expected governance to dictate his agenda which means keeping in check hardliners and their politics of polarisation. Instead, two concurrent narratives dominate the functioning of the government, economic growth and communal polarisation, and Mr. Modi and his supporters do not see any contradiction between the two tracks.

Even as the influence of the majoritarian project is undeniable, its insistence on redefining India’s national identity presents the most formidable challenge to the democratic framework in recent times and is clearly at odds with the multicultural idea of India. The question is whether this project will succeed in the long run and whether it will respect constitutionalism and common citizenship, irrespective of caste or creed.

Muslims in India need to realize that they are the minority, and must respect the culture of the majority. They must learn to lean forward and shake hands and avoid any type of confrontation and live first and foremost as Indians, not anyone else. Being an Indian citizen should be purely political; not religious. The problem with India is the mingling of politics with religion. Until this separation of religion and politics occurs, as has been the case in the United States, India will not be able to advance as a multicultural power.

Modi has successfully installed his best known acolyte (Amit Shah) at the helm of the party affairs. Never mind that he was pretty much junior in the party hierarchy. And, of course, that he is just out on bail in the case of alleged custodial murder of Sohrabuddin Shaikh does not at all appear to matter, either with Modi or his party.

Two seniormost veterans of the party have been rather unceremoniously sidelined. Advani must be finding the "gurudakshina" from his favoured "chela" too stunning to talk about.

The Union Cabinet is completely under the thumb of the PMO, perhaps as never before. Except, of course, under the Emergency. But Delhi is not Gandhinagar. Despite the media being (largely) corporate controlled and is engaged in packaging, and re-packaging, Modi with the most attractive wrappers imaginable, goings on in Delhi are bound to attract national attention. And, if it is just one-man show, in due course even the failures, just not the successes, will be attributed to him.

Moreover, the demands of the system may, rather sooner than later, may prove too huge if the system of collective working is given a go by, as the second report below draws pointed attention to :

In a Season of Deadly Rains in India, Does the New Prime Minister Believe in Climate Change?

More than 450 deaths were reported as monsoon floods ravaged parts of northern Pakistan and the Indian state of Jammu and Kashmir last week. The area is weathering the heaviest rainy season in more than half a century. A photo essay compiled for The Atlantic illustrates the awful scale of the devastation.

Thousands remain stranded as New Delhi and Islamabad mount rescue efforts, which many in the regional press have criticized as disorganized and slow.

Monsoons are an annual occurrence in South Asia, but as climate change causes greater variation in seasonal weather patterns, this is unlikely to be the last time the two countries (often at geopolitical odds) join forces.

“Something new and strange is indeed afoot,” writes the Indian environmentalist Sunita Narain for Business Standard. “Each year, the floods are growing in intensity. Each year, the rain events get more variable and more extreme. Each year, economic damages increase — and once again, development gains are lost in one season of flood or bad drought.”

While the flooding in northern India and Pakistan is partially attributable to “destroyed drainage in floodplains” because of overdevelopment and mismanaged engineering, she writes, “climate change is beginning to make the country even more vulnerable, because of the increased frequency of extreme weather events.”

According to the Global Climate Risk Index for 2014, compiled by the German environmental nonprofit Germanwatch, India and Pakistan are among the world’s most at-risk nations for climate change-induced extreme weather events. A report from the World Bank says an expected two degrees Celsius rise in the world’s average temperatures will “make India’s summer monsoon highly unpredictable” — foreboding news in a country with one of the highest population densities in the world.

As soon as the end of the century, “an extreme wet monsoon that currently has a chance of occurring only once in 100 years is projected to occur every 10 years.” Kolkata and Mumbai, two of the most populous cities in the world, brimming with vulnerable communities without access to protective infrastructure, will become “impact hotspots” for flooding, tropical cyclones and rising sea levels.

India’s future, in other words, looks wet and grim.

Despite this, Indian Prime Minister Narendra Modi will reportedly skip the United Nations climate summit scheduled for later this month in New York City, causing many to speculate as to whether the newly elected leader harbors skepticism about the science behind climate change. Recent remarks, bafflingly self-contradictory and weirdly flippant, have not soothed these concerns.

“Climate change? Is this terminology correct?” Mr. Modi asked The Hindu’s Amit Baruah last week. “The reality is that in our family, some people are old. They say this time the weather is colder. And people’s ability to bear cold becomes less.”

This clashes with Mr. Modi’s pre-election position on the topic. His e-book, “Convenient Action,” published in 2011 when he was chief minister of Gujarat, “frames action on climate change as a moral duty,” according to The Guardian’s Suzanne Goldenberg.

This further contradicted his actions in office: “As Gujarat’s chief minister, he oversaw the final phases of construction of the hugely controversial Narmada dam,” Ms. Goldenberg reports. “But he goes to great length in the e-book to promote his actions on climate change, expanding the use of solar and wind power and switching to natural gas as fuel for vehicles.”

“Since his election, Modi has dismantled a number of environmental protections,” she continues. “Clearing the way for new coal mines and other industrial projects. He also blocked funds for Greenpeace and other environmental groups and is known to be vehemently anti-NGOs.”

In a video question and answer session with students from all across India, Mr. Modi’s remarks were categorically skeptical: “The climate has not changed. We have changed,” he told a student from the eastern state of Assam. “Our tolerance and habits have changed. If we change, God has built the system in such a way that it can balance on its own.”

“He then spent the next six minutes expounding on Indian cultural values on the environment and invoking Hindu scripture, before ending with a surreal reference to threading needles by moonlight,” says Malini Mehra, an Indian environmental activist, writing for the blog Responding to Climate Change. “He had a captive audience of millions of students across the country whose future will be defined by climate change,” she laments. “But instead of educating them on the issue, why it matters to India and what his government planned to do about it, he talked about threading needles in the moonlight.”

Given that Kashmir is dealing with the worst flooding on record since the country’s independence, Ms. Mehra is at a loss: “Why can the prime minister of India not give a straight answer on climate change?”

Uttar Pradesh bypoll results: A tight slap in the face of BJP, Hindutva

Results of the bypolls in Uttar Pradesh reaffirm the faith in secular India. The BJP can mourn their losses, but for most of us Indians, it is a time to celebrate our country’s liberal spirit and rejoice in the rejection of divisive forces.

We should bring out our drums and dancing shoes because Amit Shah, Yogi Adityanath and Sakshi Maharaj have been shown their rightful place. Their brand of politics has been rejected. BJP may not accept it but the truth is it has been humiliated in UP. If the SP wins nine seats—as the trend indicates; if the BJP loses Rohinya—an assembly segment in Varanasi—let there be no confusion: this isn’t a rap on the knuckles, it is a tight slap on the face.

The biggest message here is for maun Modi. The voters have essentially spoken out against the stoic silence he has maintained on the venom frothing out of the mouths of the party’s lunatic fringe. They have reminded Modi that he has misread popular opinion by allowing his fidayeen to self-destruct themselves by carrying out their hate agendas. They have shown that UP can’t be carved up like a melon with a communal scythe.

The results prove in Indian politics, you can incite some people for some time, but in the end our liberal, secular nature prevails. It shows we all want 10 percent growth, bullet trains, clean toilets, great relations with Japan and China. But before all this, we want peace; they want to live in harmony.

Sorry, folks. But the sickulars have triumphed yet again. Like Iqbal had once famously prophesied, kuch baat hai ke hasti mit ti nahin hamari, sadiyon raha hai dushman daur-e-zaman hamara .(There must be something about us that we can’t be destroyed in spite of having several enemies.)

Will those screaming love jihad; those turning cow and beef into symbols of divisive politics; the angry internet soldier of a convoluted brand of Hinduism now shut up?

It looks inevitable.

It is a pity that the BJP took so long to learn the right lesson. It could have just looked at UP’s history to know what fate awaits its insidious, divide-and-rule brand of politics.

The BJP had done spectacularly well at the peak of the Ayodhya temple campaign. But as better sense prevailed and the communal hysteria subsided, the party’s tally returned to low double-digits. So, this round of madness wasn’t destined to last forever either.

It is a pity that the BJP lost so much of the goodwill voters had bestowed upon it by forgetting our history. No wonder, they were condemned to repeat it.

An open letter to Australian PM on ‘clean chit’ to his Indian counterpart in 2002 pogrom

Excellency,

While on a two day state visit to India, you have stated that Narendra Modi, as Gujarat Chief Minister should not be blamed for the 2002 riots in the state as he was just a "presiding officer" who has been cleared in "endless inquiries". We understand your compulsions in promoting trade & commerce with India, particularly the sale of vast stocks of unsold uranium left with your country following US led sanctions on Russia but disprove your award of a clean chit to Mr. Modi based on vague understanding of facts without any hard evaluation of evidence, direct or circumstantial.

As regards your reference to “endless inquiries”-Let me remind your Excellency that the Justice delivery system in India, which encompasses so-called inquiries, court trials and other similar proceedings are highly biased and selective against the minorities particularly Muslims. You must be aware of a new doctrine of “Satisfying collective conscience of Nation” pronounced by the highest court of this Country to hang a Muslim person, convicted of Parliament attack of 2002 through a farce trial and shoddy investigations. I hope you also remember Australian Missionary Graham Staines and his two teenage children who were killed in 1999 by a rabid fanatic, Dara Singh (He belongs to the same Hindtuva group) in a most inhuman and barbaric way by turning his vehicle a live inferno. It may add to your information that a Judge of the same Court reduced the sentence of Dara Singh from death to life imprisonment on the bizarre logic of having been influenced by religious considerations. As a quid-pro-quo, the said judge has now been appointed as Governor of one of the Southern States of India. This is how Justice delivery system works in India.

Coming to specific subject of Modi’s involvement in Gujrat riots, Let me remind your Excellency of the few acts of Commission & omission indulged in by Modi in the worst ever anti-Muslim pogrom. These are selected few points as writing in detail would entail reams of paper.

First the deeds of commission or what was actively done by Modi:

1) Modi, as CM allowed the dead bodies of Godhra train fire victims to be handed over to VHP leaders in violation of regulations on handing over such bodies only to the next of kin of the deceased. This was followed by deliberate delay to impose curfew in Ahmadabad City to facilitate the parading of dead bodies and arouse passions.

2) In the meeting held at CM’s residence on 27-2-2002 evening , clear directions in sotto voices were passed to officers to allow Hindu revengefulness against Muslims.

3) Modi made a Public announcement declaring Godhra train fire incident as a pre-planned conspiracy on 27/2/2002, though there was no such information to the Police nor any investigation held. This was enough to enrage the sentiments of Hindu Community.

4) Modi presented the pogrom in the media as operation of Newton’s Law of action- reaction. This was a clear signal to law enforcing agencies to look the other way to Muslim massacre.

5) CM ordered transfer of officers, who checked anti-minority bloodshed by armed Hindu mobs, i.e Rahul Sharma, Vivek Srivastava, M D Antani, Himanshu Bhat, etc in the thick of the riots, though DGP K Chakravorthy had objected to their transfers.

6) At the instance of CM, the administration appointed pro-VHP advocates (even office bearers of Sangh Pariwar) as Public Prosecutors in riot cases against those accused of anti-minority crimes,

7) The CM directed two Cabinet Ministers to be ensconced in the offices of DGP and CP Ahmadabad City, obviously for restraining Police from blocking anti-minority mob violence,

8) Govt. Funds were misused unabashedly to undermine a PIL before the Apex Court by Mallika Sarabai asking for a CBI investigation of riot cases.

9) Those BJP leaders who refused to carry out the anti-Muslim violence in their areas of influence were subsequently ill treated and sidelined by the CM in the party and most of them like Suresh Mehta (ex-CM) of Kutch, Kashiram Rana of Surat, Vallabh Katharia of Rajkot and Haran Pandia of Ahmedabad City had to disappear into political oblivion.

10) Those officers who lent a helping hand to the pogrom were handsomely rewarded. For instance, P C Pande, a willing police officer was given post retirement placement in the post of Chairman, Gujarat Police Housing Corporation. Similarly Ashok Narayanan, the then Additional Chief Secretary/Home was given post retirement placement as the State Vigilance Commissioner for 6 years.

11) And more recently after coming to power at center, undue influence has been exercised on the authorities below, to obtain bail orders for persons convicted of the pogrom, like Maya Kodnani & Babu Bajrangi. Incidentally after her role in the massacre was known, Kodnani was even allowed to function as cabinet Minster by Modi.

And now the deeds of omission or what was not done by Modi

1)Neither he nor any one in his Govt. visited areas of major mass killings like Naroda Patia, Gulbarg Society (Ahmadabad City), Sardarpura (Mehsana Dist.), Ode Village (SK Dist.), etc, though the he visited the site of the Godhra train fire incident and met relations of those killed in train fire,

2)Despite proposal from State Intelligence Branch (SIB), he refused to act against the media making false and communally inciting reports. Gujarat vernacular press was on the forefront of this incitement.

3)Modi refused to take follow up action on numerous SIB reports (from April to September 2002) for correcting anti-minority posture of the Govt. officials, impeding justice delivery to riot victims.

4)The CM refused to transfer officers from important executive posts in areas of high voltage violence, despite SIB recommendations, till the arrival of K P S Gill, former Punjab DGP as Advisor to the CM, in May 2002,

5) No minutes of situation review meetings chaired by the CM, were maintained making a sham of monitoring exercise, reportedly for avoiding accountability in any subsequent investigation or judicial scrutiny

6) No standard measures towards adequate relief, actual reconciliation between the riot victims and majority communities, rehabilitation and resettlement of riot victims in their pre-riot positions and areas were implemented. Even now also thousands of riot victims who were forced to migrate from their pre-riot habitats are living in sub-human conditions.

US court issues summons against Modi

Even before he touched down on U.S. soil after a nine-year visa ban, a federal court in New York has issued summons against the Indian Prime Minister Narendra Modi for his alleged role in presiding over the anti-Muslim pogrom in Gujarat during 2002 when he was Chief Minister of the state.

The lawsuit, filed by the American Justice Center (AJC), a non-profit human rights organisation identified among the plaintiffs “two survivors of the horrific and organised violence of Gujarat 2002”, and called for a response from Mr. Modi based on the Alien Tort Claims Act (ATCA) and the Torture Victim Protection Act (TVPA).

Gurpatwant Singh Pannun, whose law firm represents the plaintiffs, explained via email to The Hindu that the summons issued by the Federal Court of Southern District of New York requires Mr. Modi to respond within 21 days after it is served.

The summons document, which also alludes to the 21-day deadline, notes that if the Prime Minster fails to answer the attached complaint, “Judgement by default will be entered against you for the relief demanded in the complaint,” adding that Mr. Modi was expected to file his answer or motion with the court.

Specifically the twenty-eight page complaint filed was said to seek compensatory and punitive damages and “charges PM Modi with committing crimes against humanity, extra-judicial killings, torture and inflicting mental and physical trauma on the victims, mostly from the Muslim community”.

Mr. Pannun further noted that the “default judgement”, which in other cases has been entered against defendants in their absence, would be a “declaration from Federal Court that 2002 killing of Muslims was ‘Genocide’ as per US and international law”, and possibly grant compensatory and punitive damages for the riot victims.

According to a statement by the plaintiffs the ATCA, also known as Alien Tort Statute (ATS), is a U.S. federal law first adopted in 1789 that gives federal courts jurisdiction to hear lawsuits filed by U.S. residents for acts committed in violation of international law outside the US.

Commenting on the summons issued by the John Bradley, a Director at the AJC said, “The Tort Case against Prime Minister Modi is an unequivocal message to human rights abusers everywhere… Time and place and the trappings of power will not be an impediment to justice”.

The AJC is scheduled to hold press conference on September 26 to clarify the implications of the lawsuit filed in terms of the legal path ahead in the survivors’ quest for justice, according to a statement the organisation issued.

Why PM Modi's five-day trip to US may be a near complete waste of time

One wonders if Narendra Modi has his priorities right. Two critical state elections – in Maharashtra and Haryana - are underway where the BJP's position is far from rosy and he is heading for the US for a five-day official visit that will yield little of substantive value.

Apart from the ego trip of visiting a country that earlier denied him a visa and some flag-waving at an Indian community meeting and some entirely ephemeral political statement-mongering with President Barack Obama, Modi will largely be wasting his time in the US.

Consider the itinerary: Modi lands in New York on 26 September, so nothing will happen that day. The next day, he visits Ground Zero and Central Park and addresses the UN General Assembly (photo ops, and yawns); on Day 3 he will interact with the Indian community (speech, cheers), and also attend a dinner hosted by the Indian ambassador (handshakes, photo-ops); on Day 4 he is to deliver a policy speech at the Council of Foreign Relations, will schmooze with Hillary and Bill Clinton, and have dinner with President Obama once he reaches DC in the evening. On the final day (30 September) he will hold substantive talks with the Obama team, lunch with Veep Joe Biden, and meet congressional leaders before winding it all up with an Indo-US Business Council meeting.

If you see anything earth-shattering in this five-day agenda, let me know. None of these engagements may go beyond optics and even if there is some agreement on things that do matter to India (easier visas for software people, etc), a delay of a month or two would not have made a difference.

Consider the political and economic crises he is yet to address back home. His party is making a hash of all its alliances and Modi says and does nothing.

Having been elected on the plank of development, all - not just some - of Modi's actions must be focused on growth and jobs. But his party's outliers are busy messing up the country's politics by talking of 'Love Jihad' and making aggressive statements that smack of majoritarianism. Even the goodwill created by Modi's statement to CNN, that Indian Muslims will live and die for India, will not be enough to erase the divisiveness generated by rabid elements of the parivar.

I see no evidence that the NDA government is using the good fortune of falling global commodity prices, including oil, by reforming the subsidised energy regime.

And has Modi even focused on his core vote-winning idea of federalism? He railed against the Delhi Sultanat in his election campaign, but isn’t he creating another Sultanate by centralising decision-making and not implementing a federal plan?

Narendra Modi’s real strength is that the nation believes he is good for the country, and his very presence in the PMO is reassuring that things will change.

But Modi is in danger of getting carried away by foreigners’ adulation and lose his grip on India. It would be tempting to justify the five-day US extravaganza as intended to bring in foreign investment, but as the UPA found out to its cost, it is Indians who must first believe in investing in India. As Swaminathan Aiyar wrote in his Times of India column last Sunday (21 September), “If Indians are not rushing to invest in India, will foreigners really do so? Based on Chinese briefings, newspaper reports claimed that Xi (Jinping) would pledge $100 billion of Chinese investment in India. Actually only $20 billion of deals were signed; the rest was apparently hype.”

Modi’s US trip too is unlikely to yield much gain beyond the optics of political camaraderie. A five-day trip is a waste of Modi’s time when he has so much work to do back home.

The organisation behind a lawsuit filed against Prime Minister Narendra Modi has offered a bounty of $10,000 to anyone who could serve him with the summons issued by a federal district court and capture the service on video, sparking concerns that there could be a security incident during Mr. Modi’s historic five-day visit to the U.S.

In a statement, the American Justice Centre (AJC) said that the award for serving Mr. Modi was announced “due to the fact that the PM's visit will only last 5 days and will include a packed schedule of meetings and speeches. Servers are expected to produce a video of the serving to be eligible for the award.”

On Thursday human rights group AJC filed a 28-page complaint against Mr. Modi on behalf of multiple plaintiffs who hailed from Gujarat and suffered serious injury or the death or injury of a family member, alleging that Mr. Modi was culpable for his role in presiding over the 2002 anti-Muslim pogrom in the state.

The same day the federal court in the Southern District of New York issued summons to Mr. Modi to answer the plaintiffs within 21 days or face a “default judgment,” which could include categorisation of the 2002 riots as a “genocide” and potential compensation to the plaintiffs.

a senior administration official clarified that the summons could not be delivered to him while he was in the U.S. or attending the United Nations General Assembly, as he was immune from prosecution, and “Sitting Heads of Government also enjoy personal inviolability while in the U.S., which means they cannot be personally handed or delivered papers… to begin the process of a lawsuit.”

However, answering this argument the AJC counsel Gurpatwant Singh Pannun said, “(As) Per the precedence established in the case of former Prime Minister Manmohan Singh, the immunity extends only to acts committed during the individual’s tenure as Head of State. Our case against Mr. Modi is related to his complicity in the Gujarat pogroms of 2002, when he was Chief Minister of the state.”

In a conversation with The Hindu Mr. Pannun further explained that as this was a civil proceeding against Mr. Modi, New York laws applied at this time, and summons could simply be served by ascertaining the presence of Mr. Modi in relatively close proximity, for example depositing the summons at his feet.

However for the more creatively minded, an equally acceptable means would be to throw the summons at Mr. Modi’s feet after attracting his attention, even from ten feet away, in a way that he was made aware of the summons landing there, Mr. Pannun said.

“We are banking on community members, at least one of them, to stand up for human rights and deliver the summons,” Mr. Pannun said, adding that it was quite possible given the large number of community interactions planned in Mr. Modi’s schedule.

When asked whether this could spark any security concerns given the sensitive nature of the task Mr. Pannun said, “No, he is definitely secured and in good hands. It will just be down to an individual’s willingness to hand him a piece of paper.”

A brief glance through New York law on summons suggests that the only available option for delivering summons to Mr. Modi, who does not have a place of residence or business in the state, would be “personal delivery,” for which a copy of the summons and complaint may be served by giving it to the concerned person in their hand, after which the server must fill out an affidavit of service and return it to the court within 14 days of the service.

Although The Hindu reached out to officials of India's Ministry of External Affairs who are in New York at the moment, a reply was not received by the time this article was published.

ONE MORE RIOT IN MODI'S GUJARAT

Simmering communal tension in Vadodara after riot

The old city of Vadodara has been reeling under communal tension for last two days as members of two communities resorted to stone pelting and arson both on Thursday and Friday. Local Muslims have accused the police of bias and hotheadedness in dealing with riots, alleging that they entered their houses without permission, used abusive language, and also broke furniture and burnt bikes.

Although exact causes of the strife has not been known yet, it has been reported by a section of media that the incident began with a freak bike accident at Lehripura Darwaza in Vadodara that involved members of two communities.

It has also been reported that a morphed photograph of Ambe Maa on Kaaba uploaded allegedly by one Sanjay Raulji, also became the cause of tension as furious members of the Muslim community gathered outside his house and started pelting stones.

Soon the violence spread as members of two communities’ pelted stones at each other and put some vehicles on fire and damaged several shops. The police had to use tear gas to disperse the crowd in the in Kumbharwad area of the city. Fire fighters of the Vadodara Municipal Corporation were also rushed to the spot to control fire.

Sensing tension, there was heavy police deployment in sensitive areas since Thursday itself, still there were reports of tension between two communities and sporadic incidences of stone pelting and clashes. On Friday there were reports of clashes from Nawab Bazar, Yaquub Pura, Patel Ganj, etc.

Although the curfew has not been imposed, there is heavy deployment of police force and there is palpable tension in the area.

On Friday, Vadodara Crime Branch arrested Ayub Hasanbhai Garasiya, a history-sheeter and wanted accused in the recent communal clashes in the Fatehpura and Bhandwada area of Vadodara. Indian Express reported that the cops are not sure if Garasiya instigated mob violence in Thursday’s clash, adding that combing operation is being carried out across the city to round up suspected persons who could “threaten the law and order in the city” during the festive nine days of Navaratri.

Meanwhile, local Muslims accused the Vadodara Police of “bias and hotheadedness atrocities”, adding that they were discriminated against as the police entered their houses, used abusive language and manhandled some of them. They also alleged that police damaged their properties, although these could not be verified independently. There is no report of detention of any Hindu rioter in the incidence or Sanjay Raulji,who had allegedly posted the morphed photograph so far.

It should be mentioned here that in last couple of weeks environment has been communally charged up in Gujarat and other parts of the country in the wake of the propaganda over Love Jihad and the call of the VHP and BJP leaders to ban Muslim youths from participating in garba dance during Navratri, which began on Thursday.

The controversial cleric from Kheda Maulana Mehdi Hasan was arrested and sent to judicial custody for his alleged ridicule of Garba festival, when he apparently called garba a festival of devils. He was even slapped by the VHP worker in the court compound.

VHP has cautioned Gujarat home Secretary S.K. Nanda against government advisory note not to stop anyone from entering Garba venue. Its Ahmedabad secretary Raju Patel issued a release stating:"Is Nanda a religious leader? Do his relatives associated with famous Jagnnath temple allow Muslims in their temple?. First he should stop Mosques' loud speakers and then he should order banning loud speakers in garba".

Gujarat was comparatively free from communal riots in last one decade after the atrocious 2002 pogrom. There is fear that an attempt is being made to revive the communal tension in an already polarized state.

Why INDIA should offer so many freebies to the US residents ? The so called PIOs left India in search of green meadows, and are now US citizens. Treat them as foreign nationals. PM should use this mandate to improve the life of ordinary Indians who are living in India.

i have a question for SBM bhai here. and i would appreciate it if the topic could be stuck to and not let it degenrate into the usual "anti-Bohra/anti-Dai" tirade that most conversations turn to.

i wish to clarify this right now, at the beginning. im not gloating. im not trying to rub it in, because after reading my post, it is going to read like that, especially from people who live and breathe "anti-Bohra/anti-Dai" tirades.

that said, here it is

CAIR and all these other groups fought for so many years, stopping Modi from coming to america, lobbied to deny him a visa etc etc. what happened now? he was called with full respects, left an impact that perhaps no leader has in so many years and is talking of good things to come.

And to top it of, he mentioned Dawoodi Bohras by name, not even his own Gujju community.

Didnt you try and stop him from visiting? Didnt you tell Obama that he is a murderer, a despot, all those things you said 5 years ago?

What now? humble pie?

Should the thread name now change to "America fell at the feet of Narendra Modi too"?

Agreed with Bro Zinger that "America fell at the feet of Narendra Modi too".
Would like to add here that "Americans are most double standard people - at least in Politics".
No moral, no ethics- Only big but hollow talk.
Yesterday MODI was a persona non-grata & Today he is HERO there.
If Israelis are killing a nation - they do not object, but if Russia or any other country who are not their CHAMCHA- they made big hue & cry.

In a lighter vein : Bohras were smart in the sense that now America is following them.

No Doctor Fatema ben, my question is not aimed at USA. We all know their double standards.
My question was to SBM bhai and CAIR, since i believe, he mentioned once that they (him including) will resist him at every step of the way and ensure that he does not step foot on US soil. i would like to ask him what they did to prevent it

I am just thinking as to why a man who has been barred time and again from entering USA wants to go there as soon as he gets an opportunity. Does he not have any self-respect? Similarly SMB was ingloriously kicked out of Tanzania, but he and his children bribed their way back in. Why?
